Reopen Charles County Has Its Day In Court
The Fight for Freedom Continues
La Plata, MD (November 19, 2021) – Two months after filing its lawsuit against the Charles County Board of Commissioners, Reopen Charles County LLC has finally seen the inside of a court room. The organization representing almost 200 Charles County businesses and individuals, filed a lawsuit for injunctive relief against the August state of emergency back in September. After numerous delays, postponements, and political maneuvering, the county-based advocacy group’s legal claims are still alive.
Absent an emergency declaration by the Governor of Maryland, the citizens represented by Reopen Charles County believe the mask mandate implemented by the Commissioners was an illicit use of the Maryland Public Safety Article they were citing for authority. “The Commissioners’ actions on Tuesday, November 16 to switch their shady state of emergency mask mandate to one under the authority of their role as ‘County Board of Health’ confirmed our suspicions that they knew their actions in August were questionable at best,” said Alexandra Rak, the group’s founder.
"We were thrilled to appear before the Circuit Court of Charles County on Thursday to begin to plead our case. All efforts by citizens to find out by what metrics mask mandates will end, from what authority a local government can enact a mask mandate in the first place, and when the community can expect even a direct answer from their elected representatives has fallen completely on deaf ears. We look forward to continuing to oppose what we view as an end run around the law and a purely political maneuver by the Commissioners," said Rak.
Reopen Charles County was established as a volunteer-run movement to return to normal after COVID-19 pandemic closures in the spring of 2020. After a summer of recovery with no burdensome face coverings or capacity restrictions, the community was dismayed to see the return to an indoor mask mandate with no opportunity to present alternate arguments to the elected Board of Commissioners. The group now operates as an LLC in order to take more effective steps toward ending the mandates which put Charles County businesses and individuals at a disadvantage compared to surrounding counties.

Reopen Charles County LLC exists to represent citizens at a local or state level in issue-based advocacy efforts in which they have a stake or vested interest.
